SFMS/CMA-Sponsored Bills Clear Senate, Assembly



The Sugary Drink Safety Warning Act (SB 1000) has been approved by the California State Senate, moving the first-in-the-nation legislation on to the Assembly.

SB 1000 would place a simple warning label on the front of all bottles and cans of sugary drinks sold in California. The label, developed by a national panel of nutrition and public health experts, would read: STATE OF CALIFORNIA SAFETY WARNING: Drinking beverages with added sugar(s) contributes to obesity, diabetes, and tooth decay.

Several other SFMS/CMA sponsored bills also had success in the State Assembly:

AB 1755 (Gomez) was approved through a 75-0 vote. This bill seeks to improve California’s notice requirement for breaches of medical information by aligning state law with federal law and removing an extra administrative layer requiring health facilities to analyze all potential breaches under the both state and federal notice schemes and take different action depending on the circumstances of the potential breach.

AB 1771 (V.M. Perez) was approved through a 76-1 vote. This bill seeks to require health insurance companies licensed in the State of California to pay contracted physicians for telephone patient management.

AB 2400 (Ridley-Thomas) was approved through a 55-8 vote. If signed into law, this bill will prohibit contracts issued, amended or renewed after January 1, 2015, from including a provision that terminates a provider if he or she exercises the right to negotiate, accept or refuse a material change to the contract. It would also prohibit plans from requiring participation in unspecified current and future products or product networks, unless the plan discloses the reimbursement rate, method of payment and any other contract terms that are materially different from those of the underlying commercial agreement.
